Sheriff Sale Procedures

The Madison County Sheriff's Department holds regular Sheriff's Sales on county properties. The procedures to follow are listed in this article.

All Sheriff Sales are at 10:00 A.M. on the stated date in the Civil Office, Room 305, in the Government Center. You must be present in order to bid on any property. The Bank will start the bidding and verbal bidding will follow.

  • Do not bid if you are unsure about the property.
  • Notices are published in the Elwood Call Leader on Thursdays.
  • Property taxes are paid by the buyer in the Treasurers' Office after the sale.
  • It is the bidder's responsibility to find out if taxes are due.

Bank certified checks (guaranteed funds) for the full amount of the bid are due in the Sheriffs' Civil Office by 2:00 P.M. on the same day as the sale.

Defendant(s) are supposed to be out by 10:00 A.M. on the day of the sale. If the defendant(s) are still in the property at the time of the sale, the buyer will need to file for an Order of Eviction in the court of said action.

The Sheriffs' Department does not warrant the accuracy of the street address published on the Notice of Sheriff Sale.
